Personal Liability

These things happen- fender benders, accidents, mishaps. Sometimes it’s clear what the responsibility is on both the damager and the damagee- and sometimes it’s not. How do we come to the proper halachic resolution? Scenarios to be discussed include:

• Liability for hitting an illegally parked car

• Can the one damaged insist on using his mechanic?

• May the one damaged pocket the money and not make the repair?

• If someone was blocked in and they thought they could squeeze through but ended up damaging another car, are they liable?
